Accommodations Appeal Policy
If a student does not agree with an accommodation decision made by Learning Support Services, they may request a review of the decision under the process described below.
Step 1: Informal Review (Optional)
Students are encouraged to first talk with the LSS Learning Specialist who made the initial decision. Sometimes questions or concerns can be resolved quickly through conversation. If the student has identified new needs since the initial decision was made and/or there is additional documentation to review, the student should contact the Learning Specialist to continue the interactive process.
Step 2: Formal Appeal
If the concern is not resolved, students may submit a written appeal within ten (10) calendar days of receiving the accommodation decision to the Director of Learning Support Services (nicole.subik@villanova.edu). If the Director of Learning Support Services made the initial decision, students may address the appeal to the Associate Director (emily.f.harris@villanova.edu). The original decision remains in effect during the review process.
The appeal should explain the student鈥檚 concern and include any information the student would like to have considered as part of the appeal. The Director or Associate Director (or designee), as applicable, will review the appeal and reach out directly to the student to follow up. If the student shares new disability-related information or documentation in the appeal which was not provided to the LSS Learning Specialist, the student may be referred back to the LSS Learning Specialist to reassess the original decision in consideration of the new information.
The Director or Associate Director (or designee) will typically notify the student in writing of the final appeal decision within ten (10) business days of receiving the appeal. This is the final level of review and decision under the appeal process.
In some cases, this process may take longer for good cause and depending on the circumstances of each case, such as the complexity of issues raised, the need to gather clarifying or supplemental information from the student, or the need to speak with additional parties for relevant information. In such cases, the Director or Associate Director (or designee) will notify the student of any revised timelines.
Please note: any changes to accommodations decisions approved on appeal will be prospective, as retroactive accommodations cannot be approved. Thus, it is important for students to raise any concerns about an accommodation decision in a timely manner.
